1. Acceptance of Terms
By accessing or using Drivant ("the Service"), operated by Drivant ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Drivant is a route mapping and planning tool for delivery and logistics operations. The Service is available as a web application and desktop application (macOS, Windows). Features include route creation, stop management, route optimization, data import/export, and map visualization.
3. Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete registration information.
4. Subscription Plans and Billing
- Free Plan: Limited to viewing shared routes and .dvnt files. No editing or creation capabilities.
- Standard Plan ($29/month or $290/year): Create and edit routes with limits on stops, routes, and projects.
- Pro Plan ($79/month or $790/year): Unlimited routes and projects with advanced features including route optimization, premium exports, and satellite imagery.
- Teams Plan ($149/month or $1,490/year): All Pro features for collaborative teams. Includes 5 editor seats and 5 viewer seats with shared projects and organization management.
Subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis.
5. Free Trial and Early Access
New accounts include a 14-day Pro trial at signup. After the trial ends, accounts revert to the Free tier unless a paid plan has been activated. We may change trial duration or eligibility for future signups by updating these Terms.
6. Cancellation and Refunds
You may cancel your subscription at any time through the Account & Billing settings or via the Stripe customer portal. Upon cancellation:
- You retain access to paid features until the end of your current billing period.
- Your account reverts to the Free plan after the billing period ends.
- Your data is retained and accessible in read-only mode on the Free plan.
Refunds for paid plans are reviewed manually within 30 days of the charge. Eligibility decisions consider use, term, and prior support history. Contact [email protected] to request a refund.
7. Your Data
You retain ownership of all data you upload or create using the Service. We do not claim any intellectual property rights over your content. You grant us a limited license to store, process, and display your data solely for the purpose of providing the Service.
7a. AI Features (Receive-Scan)
The Service offers an optional AI-assisted receive-scan feature for extracting line items from photographed shipping documents (manifests, bills of lading, packing lists). When you use this feature:
- Where your data goes. Manifest images you upload are sent to OpenRouter (the AI gateway, openrouter.ai) which routes the request to upstream vision-model providers. The current upstream provider is Anthropic (Claude Sonnet 4.6). Both providers operate under enterprise terms that prohibit retaining your data for model training. See the Privacy Policy §5 for the full sub-processor list.
- Spend cap. Each organization is subject to a daily AI processing cap (default USD $5.00 per organization per day; admins can adjust this on the Billing > AI Usage card). When the cap is reached, manifest extraction is paused until midnight UTC. There is no automatic spillover to additional charges.
- What's billed. AI processing is included in your subscription tier as a fair-use allowance. We reserve the right to throttle or charge for usage that materially exceeds typical operational patterns. Any per-call cost overage will be communicated in advance and reflected on your invoice.
- Your data is yours. Extracted line items, dispatcher overrides, and audit trails remain on your account and can be exported via the portability endpoints. Manifest image retention is configurable per organization on Team Settings > Manifest Image Retention. Defaults: 180 days (Free, Standard); 1 year (Standard max), 2 years (Pro), 7 years (Teams). Enterprise customers may set indefinite retention to satisfy DOT/FMCSA archival requirements. Extracted line-item rows are retained for the 2-year transportation audit window regardless of image retention.
- Accuracy disclaimer. AI extraction is a best-effort assistive tool, not a guarantee. You are responsible for reviewing and confirming extracted data before relying on it for downstream operations (deliveries, claims, regulatory filings).
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell or redistribute the Service without our written permission
- Use automated tools to access the Service beyond normal use
9. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by Drivant and protected by copyright and other intellectual property laws. The Drivant name and logo are trademarks of Drivant.
10. Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Drivant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.
12. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.
13. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.
